Terms of Service
These are the terms for working with Borg Sites. We have kept them fair and readable, no scary fine print. They explain what we offer, how billing works, who owns what, and the usual legal basics.

1. Accepting these terms
By using borgsites.com, requesting a quote, or buying any Borg Sites service, you agree to these Terms of Service and to our Privacy Policy. If you are agreeing on behalf of a business, you confirm you are allowed to do so. If you do not agree, please do not use our services.
2. What we offer
Borg Sites is a website-building platform and a design studio. You can build and publish a website yourself, or ask us to do it for you. Our services include:
- The Borg Sites platform (free or paid). An account, the ready-made templates, Borg Studio, the editor, previewing and publishing. You build, customize and publish the site yourself, on a free borgsites.com address or on your own domain, and you can add managed help when you want it. The AI builder is here: describe your business in your own words and it drafts the site for you.
- Design builds (one-time). A website or brand project we design and build for a single, agreed fee, based on its scope.
- Hosting & Care (monthly or yearly). A subscription that hosts your site and keeps it fast, secure and maintained, with the pictures and files you store copied to a second store and checked by an automatic daily job. Billed monthly, or yearly at 12 months for the price of 10, whichever you choose at checkout. Eligible plans billed monthly start with a $1 first month as an introductory offer, then renew automatically at the plan's stated monthly price until you cancel; plans billed yearly are charged once a year and renew yearly until you cancel.
- Add-ons. Extra pages, content, features and services, priced individually.
- Domains. Registration, renewal and management through our Domain Dominion service.
For anything we do for you, we will always confirm the scope and price in writing before we begin.
3. Your Borg Sites account
Building the site yourself starts with an account. No card is required to create an account or publish on the free Launch plan. A card is required only when you select a paid plan, purchase a Design build or approve billable usage.
To open an account you need to be old enough to agree to these terms where you live, and if you are opening it for a business you confirm you are allowed to agree on its behalf. Borg Sites is a business service and is not for children.
One account per person, please. The account is yours to look after: keep the password to yourself, and tell us at support@borgsites.com if you think somebody else has it. We store your password only as a one-way scrambled value, so we can never tell you what it is, only help you set a new one. Anything done through your account is treated as done by you.
What each plan includes is on the Pricing page. How it is billed, renewed and cancelled is in section 4.
4. Billing, renewal and cancellation
- One-time builds. Billed as agreed for your project, typically a deposit to start and the balance on completion.
- Hosting & Care billed monthly. Billed every month and renews automatically at the plan's stated monthly price until you cancel.
- Hosting & Care billed yearly. Charged once a year, at 12 months for the price of 10, and renews automatically each year until you cancel. Choose yearly at checkout and you pay for a full year up front at ten months' price.
- The $1 first month is a promotion. On eligible Hosting & Care plans billed monthly, the first month of your first plan with us is $1. It applies to your first invoice only: your regular monthly price begins one month after you sign up, and we always show you that price, and the date it starts, before you pay. It does not apply to plans billed yearly and the two offers do not stack, because the yearly offer is the two free months already in the yearly price. During that first month the AI builder includes 15 builder credits, and your plan's full monthly allowance starts once your first full-price month is paid.
- Annual services. Annual services, such as Domain Dominion, are billed once a year.
- Hosting & Care: cancel anytime. Cancel the plan yourself from your dashboard, or email support@borgsites.com and we will take care of it. Both routes follow exactly the same rules, the ones below included. Your service continues to the end of the period you have paid for, whether that is the current month or the current year, unless the 5-day money back below applies, in which case the money comes back and the plan ends that day.
- 5-day money back on hosting. Cancel within 5 days of your first Hosting & Care charge and we refund your hosting payments in full, less what we paid to register a free domain, if one was registered, and the plan ends that day rather than running on. This applies to a first yearly charge exactly as it applies to a first monthly one. It covers your Hosting & Care payments and nothing else: design builds, first-year domain registrations and one-time add-ons, such as template customization, migrating an existing site and site handoff, sit outside it. Builds follow the rule below, and we settle anything else one-time with you directly. When moving your existing site is free with your order, we start the move once those 5 days have passed.
- No refunds for unused time. Outside that 5-day window we do not refund partial months, unused months of a paid year, or any other unused time, unless a refund is required by law. If we ever bill you in error, tell us and we will make it right.
- A courtesy stays a courtesy. Outside every rule above we sometimes put money back, or a credit on your account, because a week did not go the way we wanted it to. Your plan carries on exactly as it is. It is ours to offer rather than yours to claim, and doing it once does not commit us to doing it again.
- Design builds are custom work. Cancel before work has begun and we refund your build payment in full. If you cancel after work has begun, we retain the value of the work completed to date and refund the remainder. After delivery, build payments are not refundable, and the included first week of revisions is how we make things right, all per your project agreement.
- Combined orders. If you bought a build and a hosting plan together, each part follows its own rule above, and the 5-day money back covers the hosting portion only.
- What happens to your site when a paid plan ends. Nothing is deleted. Your account goes back to the free Launch plan and your site keeps running there, on the free plan's limits and carrying its small "Built with Borg Sites" line. You can move back up, or delete the site yourself, whenever you like.
5. Custom domains
Every plan always includes a free borgsites.com address (borgsites.com/s/yourname), and it stays yours for as long as your account is open. A custom domain is optional, and these are its terms:
- The domain is yours. A domain we register for you is registered for you, and you can move it elsewhere. We manage it, we do not own it.
- Domain Dominion, $17.99 a year. Domain registration and auto-renewal, DNS fully managed, domain-expiry and hijack monitoring, and WHOIS privacy. Billed once a year, and it renews automatically until you tell us to stop.
- Free for your first year on eligible plans. A .com is free for the first year on any Design build and on Orbit Hosting & Care and up. After that it renews at a members' rate that gets lower the higher your plan, from $11.99 a year on our top plan, and $17.99 a year on Launch and Spark. Other endings, such as .net or .io, are priced separately, just ask.
- Bring your own instead. Keep a domain where it is and keep managing your own DNS. Email us and a real person sends you the exact records to point it at your site and confirms everything is connected. Connecting your site never touches your email records.
- An availability check is not a reservation. When our checker says a name looks available, that means the registry had no record of it at that moment. Anyone can register it before you do, and some names are reserved, premium or held back by the registry.
Domain renewals are yearly and automatic. A domain nobody renews is released by the registry, and that is not something we can undo, so please keep your billing details current.
6. Your responsibilities
So we can do our best work for you, you agree to:
- provide the materials, content and access we need, and to do so in good time,
- make sure everything you give us is accurate, and that you own it or have permission to use it, and
- use your site and our services only for lawful purposes.
You are responsible for the content you publish through your site. Section 7 says what that means when you are building and publishing it yourself.
7. What you publish through Borg Sites
When you build the site yourself, everything that goes into it is yours to stand behind: the words you type into the AI builder, the pictures you upload, the copy you write in the editor, and everything you publish. You agree that:
- you own it, or you have permission to use it, photographs, logos, fonts and anything else you did not make yourself included,
- it is lawful where you are and where your customers are, and it infringes nobody's rights,
- it does not impersonate another person, business or brand, and it claims no endorsement, certification or affiliation you do not have,
- it carries no malware, no phishing, no deceptive redirect and nothing built to harm a visitor or their device,
- it is honest about who you are and what you sell, and
- it follows the acceptable-use rules in section 8.
The same goes for what you type into the AI builder and the picture generator. Do not ask them for something you could not lawfully publish yourself, and do not try to talk them into producing it. We may refuse a request, and the tools may refuse one on their own.
The AI tools are a starting point, not a lawyer and not a fact checker. Read what they give you before you publish it. What goes live is your decision and your responsibility.
8. Acceptable use
You agree not to use Borg Sites, or a site you build on it or we host for you, to break the law, infringe anyone's rights, send spam, host malware, or publish content that is unlawful, hateful or harmful. If content or a site breaches this section, we may suspend or remove it, and we will tell you why. Section 9 says how we go about that.
9. Publishing, suspension and ending your account
Publishing is yours to do. A site you create is live from that moment at borgsites.com/s/yourname, or at your own domain, and it is a public web page: anyone with the address can read it, and search engines can find it. There is no separate publishing step holding it back, so treat everything you put on a site as public. You can change it or take it down whenever you like.
A draft in the AI builder is not a published page. It stays in your account, nothing in the builder puts anything on the web, and only you and we can see it.
Your own controls. Delete a site from your dashboard and the site and its whole version history go with it. Delete a picture from the editor and both our record of it and the copy we serve are removed, though a picture still in use on one of your pages is left alone until you swap it out. Cancel a paid plan from your dashboard under section 4. To close the account itself, email support@borgsites.com from the address on the account and we will do it, and our Privacy Policy says exactly what that removes.
Our controls. If content on a site breaks section 7 or section 8, we may take it down or make the site unavailable. We will tell you what we acted on and why, and give you a chance to put it right, unless the law, a court, a payment rule or an immediate risk to other people means we have to act first. Where we can, we act on the one thing that is wrong rather than on the whole site.
We may close an account for a serious or repeated breach of these terms, for using the service to harm somebody, or for non-payment after we have told you and given you a fair chance to settle it. If we close your account we will say why, and we will give you a reasonable chance to take a copy of the content you put into it first, unless we are not allowed to. If you close your account, or a paid plan simply ends, section 4 says what happens to your site and section 11 says how to take it with you.
10. Who owns what
- Your content stays yours. The words, pictures, logos, files and settings you put into your site are yours, and nothing here changes that. You give us only the permission we need to do the job: to store your content, back it up, keep version history so you can undo a change, show you a preview, and publish it to your visitors. That permission ends when you delete the content or close the account, except for the backup copies described in our Privacy Policy, which we keep until you close the account or ask us to remove them.
- Your domain stays yours. A domain we register or manage for you is registered for you, and you can move it elsewhere. See section 5.
- What the AI tools make for you is yours to use. A draft, a layout, a piece of copy or a picture produced by the AI builder or the picture generator is your content, and we claim no ownership of it. We cannot promise it is unique: these tools work from patterns, so another customer asking for something similar can be given something similar. We make no warranty of originality, novelty or non-infringement, and none that anything they produce can be registered as a trademark. Check anything you intend to rely on, a business name or a logo most of all.
- When you have paid in full for a one-time build, you own the final delivered website and the custom visuals we created for it.
- Borg Sites keeps ownership of its own underlying tools, code libraries, templates, systems and know-how, including anything we reuse across clients. Where your build includes these, you receive a license to use them as part of your site.
- Templates, Borg Studio and the platform are licensed, not sold. Every ready-made template, the AI builder, the editor, Borg Studio and the platform underneath them stay ours. While your account is open you have a license to use them to build, publish and run your own site on Borg Sites. You may not resell them, redistribute them, or lift a template off the platform to run it somewhere else, except through the site handoff in section 11.
- While you are on a Hosting & Care plan, your hosting is provided as a license for the length of your subscription. Third-party components, such as fonts, stock assets or software, remain subject to their own licenses.
11. Taking your site with you
There is no lock-in. Your content and your domain are yours (section 10), and the site itself can go with you:
- Site handoff, full code export, $250 one time. We package your complete site, clean, portable code and all assets, and hand it over the same day. It is yours to host anywhere.
- Site handoff plus setup and training, $500 one time. Everything in the export, plus we deploy it on your hosting, connect your domain and DNS, and give you a 1-on-1 training session.
Either one is available on any plan, the free Launch plan included: a site you built yourself for nothing is exported on exactly the same terms as any other. A handoff gives you a license to run that exact site, template and all, wherever you like. It does not license you to resell the template, or to use our tools and platform anywhere but on Borg Sites.
You can copy your own content at any time without paying anything. The words, pictures and files you put in are yours, and if you ever decide to leave we will help you export and move everything cleanly. The $250 and $500 are for the packaged, deployable code and the work of preparing it.
12. If we build it for you
A professional Design build is a different kind of purchase from a self-service plan, and it keeps the terms it has always had. Its cancellation and refund rules are the "Design builds are custom work" rule in section 4: a full refund before work has begun, the value of the work completed to date retained if you cancel part way, and the included first week of revisions rather than money back after delivery. Its ownership is the build bullet in section 10: once you have paid in full, the finished website and the custom visuals we made for it are yours. Your own project agreement sets the scope, the schedule and the deliverables, and it is the document that governs the work itself.
13. Availability and disclaimers
We work hard to keep your site fast and available. It is served over HTTPS from our hosting provider's network, with the protections our Privacy Policy lists in plain terms, and every picture you store is copied to a second store the moment it is saved, with an automatic daily job checking the two against each other.
That said, we are a small team. We do not offer an uptime guarantee or a service credit, and we cannot promise the service will be uninterrupted or error-free, nor guarantee any particular result, search ranking or amount of business. Features we describe as rolling out are not available yet, and nothing here promises a date for them. Our services are provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. Apart from what your own project agreement promises for a build we make for you, the promises on this page are the only ones we make, and nothing is implied on top of them.
14. Limitation of liability
To the fullest extent the law allows, Borg Sites is not liable for indirect, incidental or consequential losses, or for lost profits, lost revenue, lost business, or for content or data you did not keep your own copy of. Our total liability for any claim relating to our services is limited to what you paid us in the twelve months before the claim arose. Nothing in these terms limits any liability that cannot be limited by law.
So please keep your own copy of anything you would hate to lose. Every picture you store is copied to a second store the moment it is saved and the two are checked against each other daily (section 13), and your saved versions are there to undo a change, but a safety net of ours is not a promise that nothing can ever go wrong.
15. Indemnification
You agree to cover Borg Sites for reasonable claims, damages and costs that arise from content you provide or publish, or from your misuse of our services or breach of these terms.
16. Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Any dispute relating to them will be handled in the state or federal courts located in New York.
17. Changes to our services and prices
We may add, change, retire or reprice any of our services at any time, including plans, hosting, care, domains, email, features and add-ons. When a change affects something you already pay for, we will let you know in advance, with enough notice for you to decide what you want to do, and the change will take effect only after that notice period, at your next renewal where one applies. A term you have already paid for is not repriced during that term. If you do not want to continue under the changed service or price, you can cancel before it takes effect, and the cancellation and refund policy in section 4 applies.
18. Changes to these terms
We may update these terms from time to time. When we do, we will change the effective date shown at the top of this page. If a change is significant, we will make reasonable efforts to let clients know. Continuing to use our services after an update means you accept the revised terms.
